MonuOS Terms of Service

These Terms of Service ("Terms") govern access to and use of the MonuOS platform — the software-as-a-service offering available at monuos.com and app.monuos.com, including hosted shop websites, memorial pages, and related services (together, the "Service"). By creating an account or using the Service, you ("you," the "Shop," or the "Customer") agree to these Terms.

1. The Service (SaaS subscription)

MonuOS provides business software for monument, memorial, and granite companies on a subscription basis: order and production management, design proofs, customer communication, invoicing and payments, marketplace features, hosted websites, and related tools. The Service is provided on a hosted, multi-tenant basis; we may improve, add, or modify features on an ongoing basis. Features described in marketing materials may evolve.

You agree not to: (a) use the Service for unlawful, deceptive, or abusive purposes; (b) send spam or messages without required consent; (c) attempt to access another shop's data or probe, scan, or test the vulnerability of the Service; (d) interfere with the Service's operation or circumvent usage limits or marketplace protections; (e) upload malicious code; or (f) resell the Service without our written agreement. Our full Acceptable Use Policy, presented in-app, also applies. We may suspend accounts that put the Service or other shops at risk.

5. Data import and export responsibility

Import, export, and synchronization features move business and accounting data between systems at your direction. You are responsible for reviewing imported and exported records for accuracy and completeness — including previews shown before any export — and for maintaining appropriate backups of your accounting records. Accounting data is never modified in an external system without an explicit, admin-confirmed action from your shop. MonuOS is not your accountant, bookkeeper, or tax advisor, and the Service does not replace professional review of your books.

7. Disclaimers and limitation of liability

The Service is provided "as is" and "as available." To the maximum extent permitted by law, MonuOS disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. MonuOS does not warrant that the Service will be uninterrupted or error-free.

To the maximum extent permitted by law: (a) MonuOS will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill; and (b) MonuOS's total liability for all claims arising out of or relating to the Service will not exceed the amounts you paid to MonuOS for the Service in the twelve (12) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

We may update these Terms from time to time. Material changes will be communicated in-app or by email, and continued use after the effective date constitutes acceptance. The in-app terms acceptance flow records the version each account has accepted.
